Please read this page carefully and if you are under 18 years of age, ask your parents or guardians to read this page and explain the rules to you. By using the Website you (and your parents or guardians) agree to be bound by the rules and all subsequent Terms and Conditions.

BOOKING TERMS AND CONDITIONS

The website of familytravel.com.au (“the Site”) is owned and operated by Bound Round Pty Ltd, ABN 62 155 213 853, trading as Family Travel Online, TIDS No. 96809624.

Please read the following terms and conditions carefully. You should not buy your holiday or travel voucher unless you understand and agree with the following terms and conditions. References to “us”, “we” and/or “our” in these booking terms and conditions shall mean the Bound Round Pty Ltd.

These terms and conditions apply to bookings you make with us via phone, email, catalogue, face-to-face as well as online bookings you make on our website.

We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions.

Your holiday contract

When making a booking you guarantee that you have the authority to accept, and do accept on behalf of your party, the terms of these booking conditions. It is your responsibility to check the accuracy of the details you provide upon booking, ensuring passenger name details exactly match passport details. If any of the details on the confirmation voucher are incorrect, you must notify us immediately. We will pass on any additional charges incurred as a result of these details not being correct. We reserve the right to refuse to accept and/or not proceed with any booking at any time at our sole discretion. This contract is governed by Australian law and the jurisdiction of the NSW courts.

FamilyTravel.com.au holidays have been selected because they specifically cater for families . Please note there may be non-FamilyTravel.com.au travellers (including those without children) in residence during your holiday or travelling with your group. Unfortunately we cannot accept responsibility for other people’s behaviour, however we’ve done our best to select travel providers who understand the needs of FamilyTravel.com.au customers and who will deliver you a great holiday experience.

Prices

All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed once paid for in full by you, or once the first instalment or deposit payment has been received. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Please contact us for up-to-date prices.

For orders on FamilyTravel.com.au, the prices that are listed at the time of your order on the product page apply. The prices are final prices inclusive of GST (where applicable) and all other price components (including relevant taxes and charges).

All prices quoted byFamilyTravel.com.au exclude all credit card & booking processing fees.

FamilyTravel.com.au 30 Day Booking Guarantee

TheFamilyTravel.com.au 30 Day Booking Guarantee means that if you can’t get the travel dates you want within 30 days of buying the voucher, we’ll give you your money back, no questions asked.

Once you have booked in dates for your voucher, the cancellation and change policies of the provider you are travelling with will apply. These are detailed in the Fine Print section of each holiday offer on FamilyTravel.com.au

In addition, FamilyTravel.com.au will provide a refund where:

  • we are required by law to do so;
  • we have made a mistake in advertising an offer that fundamentally misstates the product or service that is the subject of the offer;
  • prior to the redemption of the voucher during the validity period as provided in the fine print of that offer, the provider of the offer ceases trading or ceases to provide the subject matter of the offer.

Cancellations After Travel Booking Has Been Confirmed

For cancellations after travel has been confirmed, the travel operator may impose cancellation fees. In addition,FamilyTravel.com.au will charge a $100 per person cancellation fee. We recommend taking out travel insurance as soon as you have booked your travel dates so you have protection against emergency cancellations that might be needed.

Accessibility of Travel Voucher / Booking Confirmation 

You agree that we are not liable for any loss suffered as a result of you being unable to download, print or access a voucher or booking confirmation.

FamilyTravel.com.au Service Guarantee

Our booking and travel services come with our guarantee that:

  • they will be provided with due care and skill;
  • they will be reasonably fit for the specified purpose;
  • they can reasonably be expected to achieve the desired result; and
  • they will be provided within a reasonable time.

If we fail to meet any of these guarantees, you have rights under the Australian Consumer Law.

Passports & Visas

All travellers must have a valid passport for international travel and many countries require at least 6 months validity from the date of return and some countries require a machine-readable passport. When assisting with an international travel booking, we will assume that all travellers on the booking have a valid Australian passport. If this is not the case, you must let us know.

It is important that you ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility (except to the extent caused by fault on our part).

If you need information regarding visas, passports and other travel document requirements for your trip, please contact us on 1300 404 100. We can provide you with general information on visa and passport requirements that apply to international travel bookings you make with us.

For more specific information, you can contact an external visa provider such as Visa Central directly. We do not warrant the accuracy of information provided by any external service and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part).

If you are travelling to the United States please see https://esta.cbp.dhs.gov for important information regarding compulsory pre-registration for their visa waiver program (“ESTA”). Australian passport holders will not be able to enter the United States without a valid ESTA (or visa). Please note, you may not meet the eligibility requirements of ESTA and may be required to obtain a visa.

If you are travelling to Canada please see http://www.cic.gc.ca/english/visit/eta.asp for important information regarding compulsory electronic travel authorization for visa-exempt foreign nationals (“ETA”). Australian passport holders will not be able to enter Canada without a valid ETA (or visa) from 15 March 2016. Please note, you may not meet the eligibility requirements of ETA and may be required to obtain a visa or permit.

Travel Insurance

We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Travel insurance is also strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel.

Travel Advice

We recommend that you contact the Department of Foreign Affairs and Trade (DFAT) or visit their website at www.smartraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination you wish to visit. You can also register your travel plans with DFAT, so that you may be more easily contacted in an emergency.

Health

You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel. General health advice for the destination you wish to visit is also available from DFAT (see smartraveller.gov.au).

Travel Documents

Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Please review your travel documentation carefully and advise the relevant booking partner of any errors in names, dates or timings. You should print out and retain your travel documents as provided to you by the website (or in a follow up email we send you).

Room Bedding Guide

All prices on this website are based on existing bedding in the room. Requests for particular arrangements must be made at the time of booking (for example, twin share, separate beds, additional rollaway beds may be arranged at time of check-in and additional charges may be payable direct to the hotel). Some hotels may also have maximum capacity for particular rooms.

Frequent Flyer Points

Airfares may or may not attract Frequent Flyer points. This decision rests with the airline and is not the responsibility of the FamilyTravel.com.au. For further information please contact the airline directly.

Agency

We act as an agent for, and sell various travel related products as agent on behalf of, numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators, as well as all of our wholesalers. Any services we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers. We can provide you with copies of the relevant service provider terms and conditions on request. Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.

Other conditions

It is your responsibility to comply with the terms, conditions and requirements of any service provider, or any country or governmental authorities, or to bear any costs or losses incurred as a consequence of you not complying with them.

Liability

To the extent permitted by law, neither FamilyTravel.com.au nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

Governing Law

If any dispute arises between you and us, the laws of Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Australia, and waive any right that you may have to object to an action being brought in those courts.

Acknowledgement

You acknowledge that you are 18 years of age or older and that you understand and agree with the above Booking Terms and Conditions and our Privacy Policy.

The FamilyTravel.com.au website may include links to other websites, content or resources. These linked websites, content or resources may be operated by third parties and we may have no responsibility or control over them.

The existence of these links does not imply that we endorse the linked website, content or resource. You acknowledge that we have not reviewed any of these third party websites, content or resources and we are not responsible for the material contained therein.

Website Changes

We reserve the right to change, alter, vary or amend the Website at any time. We may in our sole discretion terminate your account or restrict your access to the Website. If we do this, you may be prevented from accessing all or parts of the Website, your account details, or other content contained in your account. In the event that this occurs you will still be entitled to access those vouchers that you had previously purchased through the Website.

Complaints or Problems 

We endeavour to ensure that the arrangements we have made for you are implemented as arranged. If a problem occurs, the most practical way to deal with it is to attempt resolution locally with the supplier (such as the hotel, tour operator or airline).

If you fail to follow this course, any claim for compensation may be reduced or denied. If you have any unresolved complaint, details should be lodged in writing (with supporting documentation, including efforts made with the service provider to resolve it) directly to the Company within 30 days of return to from your trip.

We have no liability (including for loss or damage) for any act, omission or default, whether negligent or otherwise of any merchant. If you wish to make a complaint in respect of a merchant, you must email that complaint to familytravel_feedback@boundround.com

Notwithstanding the nature of the complaint, Refunds will only be provided in accordance with our Refunds Policy.

Intellectual Property

We reserve all intellectual property rights, including but not limited to, copyright in material and/or services provided by us. Nothing in the agreement gives you a right to use any of our marketing material, business names, trademarks, logos, domain names or other distinctive brand features.

Other trademarks used on FamilyTravel.com.au that belong to third parties are used with their consent and remain the intellectual property of that party.

If you correspond or otherwise communicate with us, you automatically grant to us an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display and distribute the content of your correspondence or communication and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content. This may include, but is not limited to, publishing testimonials on the Website and developing your ideas and suggestions for improved products or services we provide.

Change of Control

Subject to relevant laws, if we merge, sell or otherwise change control of our business or the FamilyTravel.com.au website, we reserve the right, without giving notice or seeking consent, to transfer or assign your Personal Information, content and rights that we have collected from you and any agreements we have made with you.

Communication by Us

As a condition of registering for familytravel.com.au, you consent to us sending you Administrative Emails and Promotional Emails. In this document:

  • ‘Administrative Emails’ involve details of account activity and purchases you have made
  • ‘Promotional Emails’ consist of product information and new offers. You may choose to opt-out receiving promotional emails anytime by simply clicking the unsubscribe button at the bottom of our emails. More details about these emails can be found in our Privacy Policy

Gift Vouchers

familytravel.com.au vouchers (including but not limited to; hard-copy and/or digital gift or promotional vouchers, promotional codes, credits) are personal to the Member receiving them.

familytravel.com.au vouchers are not transferable, have no monetary value and under no circumstances can they be converted into currency. The use of a familytravel.com.au voucher requires the total value of the order to be higher than the monetary value of the discount given by a familytravel.com.au voucher/s.

familytravel.com.au reserves the right to specify a minimum spend for which familytravel.com.au vouchers are permitted to be used. In this case, the monetary value of the order (excluding delivery costs) has to be higher than the minimum spent.

Only 1 familytravel.com.au Voucher can be used per member per sales event. familytravel.com.au reserves the right to cancel Vouchers if they were improperly obtained, including but not limited to violation of the familytravel.com.au Terms and Conditions.

In order to apply the credit from a Voucher (digital or hard copy) members will be prohibited from using any additional promotional discounts, credits, promotional codes or credits from additional gift cards (hard copy or digital).

Use of the Website by You

  • You agree not to access (or attempt to access) any part of the Website by any means other than through the interface provided by us.
  • You agree that you will not engage in any activity that interferes with or disrupts the website or the servers and networks that host the Website. You may not use data mining, robots, screen scraping or similar data gathering and extraction tools on the Website except with our prior written consent.
  • You agree not to, or attempt to, circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any content or enforce limitations on the use of the website or the content therein.
  • You agree not to use, copy, distribute or commercialise content except as permitted by this agreement, by law or with our prior written consent.
  • You understand and agree that any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities.
  • We reserve the right to cancel your registration at any time, subject to our complete discretion. In the event that you have previously purchased a voucher or vouchers, we will email you a copy of any vouchers prior to cancelling registration. In the event of cancellation of registration, our decision is final and binding.

Governing Law
